The long-running litigation between BSkyB and IT firm EDS has settled for £318 million.
BSkyB’s claim related to losses incurred because of deficiencies in the contact
management systems built for it by EDS.
EDS sought to rely on a limitiation clause in the contract, which would have restricted its liability under the contract. However, the clause was ruled by the court not to apply because EDS had made false representations which had been material in misleading BSkyB..
The case has implications for both suppliers and buyers of IT related services.
