Five-Figure Damages for Holidaymaker’s Paving Stone Fall

A woman who was injured when she fell over a paving stone on the first day of her holiday has obtained compensation.

The woman was on a package holiday in Turkey with her husband. They were on their way to dinner and were walking along a path consisting of individual paving stones when one of the stones moved under her husband’s weight. She was walking behind him and caught her foot on the raised edge of the stone, falling to the ground and fracturing her left ankle.

She was taken by ambulance to hospital. She was put in a plaster cast and later a boot. Following her return home, she needed weeks of rest and recovery.

She brought a claim against the company that had provided the package holiday. Fortunately, she and her husband had taken photos and videos of the area where the accident happened, indicating that the paving stones posed a tripping hazard. Medical evidence was also prepared.

Although the company denied liability, a five-figure settlement was agreed. As well as compensating her for her pain and suffering and the loss of her holiday, the damages reflect her loss of earnings and her husband’s care and assistance during her recovery.
