A lorry driver who argued that the settlement for the motorist he hit as he alighted from his car should be reduced because the victim was parked illegally recently failed to persuade the court that this constituted contributory negligence.
The court ruled that the car was as visible parked on the zig-zag lines by a zebra crossing as it would have been in normal circumstances and that there was therefore no contributory negligence on the part of the driver.
