More Confusion Over Names

Another recent decision involving similar names saw the General Court confirmed the OHIM Board of Appeal’s decision that the name ‘Smartwings’ was likely to be confused by consumers with the name ‘Eurowings’ when used to goods

and services relating to aviation and an application to register the name as a trade mark was therefore rejected.

It would thus seem that any name relating to avaition services based on the suffix ‘wings’ might present a problem
